Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of Courtly(“Courtly”, “we”, “us”, or “our”) as a player or guest to discover and book courts, join open play, and register for tournaments. Please read them carefully.

These Terms are for players and guests. If you operate or manage a venue, your use of Courtly is governed by a separate agreement that you accept within the platform.

1. Acceptance and eligibility

By creating an account, making a booking, or otherwise using Courtly, you agree to these Terms and to our Privacy Policy. You must be at least 18 years old and able to enter into a binding contract under Philippine law. If you do not agree to these Terms, please do not use the service.

2. What Courtly is

Courtly is an online platform that connects players with venues offering courts and related activities. We are not the venue and we do not own, operate, manage, or control the courts or facilities. The venue is solely responsible for the court, its condition, availability, and the services it provides. Courtly facilitates discovery, booking, and communication between you and the venue.

3. Your account

  • You agree to provide accurate, current, and complete information when registering.
  • You are responsible for keeping your password and account secure, and for all activity that occurs under your account.
  • Notify us promptly through our Contact page if you believe your account has been used without your authorization.

4. Bookings and payments

  • All prices are shown in Philippine Pesos (₱) and may include a platform booking feein addition to the venue’s court charge.
  • Payment is made manually to the venue via GCash or Maya. You upload a screenshot of your payment as proof, which the venue reviews. A booking is not confirmed until the venue verifies your payment.
  • When you start a booking, your slot may be held for a limited time so you can complete payment. If payment is not completed in time, the hold expires and the slot is released to others.
  • You are responsible for ensuring your payment details and proof are accurate. Submitting false or altered payment proof may result in cancellation and suspension.

5. Cancellations, refunds, and reschedules

  • Cancellation and refund policies are set by each venue.Because the venue provides the court and receives your payment, any refund of the court charge is subject to that venue’s own policy. Please review the venue’s terms or contact them directly regarding refunds.
  • The platform booking fee is generally non-refundable, except where required by law.
  • A booking may be rescheduled once, subject to availability and the venue’s approval. Price differences for a rescheduled slot may apply.
  • No-shows and late arrivals are handled according to the venue’s policy.

Nothing in this section limits any rights you may have under the Consumer Act of the Philippines (Republic Act No. 7394) or other applicable law.

6. Open play and tournaments

Open play sessions and tournaments are organized by hosts or venues. Capacity is limited and slots may be held while you complete payment or approval. Hosts and organizers may set their own rules (such as skill level or format), and may approve, decline, or remove participants in line with those rules. You agree to participate respectfully and to follow the organizer’s and venue’s instructions.

7. Reselling or transferring bookings (“pasalo”)

Where the platform allows a booking to be reassigned to another player, any such transfer is arranged between the players at their own risk. Courtly does not act as an escrow, does not guarantee the transfer, and is not a party to the arrangement between the original and the new player. You are responsible for settling payment and any conditions of the transfer between yourselves.

8. Your conduct and content

You are responsible for the content you submit, including reviews and open play messages. You agree not to post content that is false, misleading, unlawful, defamatory, harassing, obscene, or that infringes the rights of others. You must not misuse the platform, attempt to gain unauthorized access, or disrupt its operation.

By submitting content, you grant Courtly a non-exclusive, royalty-free license to display and use that content for operating and promoting the service. We may review, flag, moderate, or remove content that we reasonably believe violates these Terms or applicable law.

9. Intellectual property

The Courtly name, logo, software, and the design and content of the platform (excluding user-submitted and venue-submitted content) are owned by Courtly or its licensors and are protected by law. You may not copy, modify, distribute, or create derivative works from them without our permission.

10. Disclaimers

Courtly is provided on an “as is” and “as available” basis. We do not warrant that the service will be uninterrupted or error-free. We are not responsible for the condition, availability, safety, or quality of any venue’s courts or services, nor for the conduct of venues or other users. Any dispute regarding the court or the service provided is between you and the venue.

11. Limitation of liability and indemnity

To the fullest extent permitted by Philippine law, Courtly shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform, or from your dealings with any venue or other user. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including your rights as a consumer. You agree to indemnify and hold Courtly harmless from claims arising out of your breach of these Terms or your misuse of the service.

12. Suspension and termination

You may stop using Courtly at any time. We may suspend or terminate your access if you breach these Terms, misuse the platform, or where required to protect the service or other users. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will continue to apply.

13. Governing law and disputes

These Terms are governed by the laws of the Republic of the Philippines, including the Electronic Commerce Act (Republic Act No. 8792), the Consumer Act (Republic Act No. 7394), and the Civil Code. We encourage you to contact us first so we can try to resolve any concern in good faith. Any dispute that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the competent courts of the Philippines.

14. Privacy

Our handling of your personal data is described in our Privacy Policy, which forms part of these Terms.

15. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of Courtly after an update means you accept the revised Terms.
